Which rule you answer to depends on how you are chartered and who regulates you. Here is the short version, and where technology fits into it.

FTC Safeguards Rule

If the FTC is your regulator

  • Designate a qualified individual to run the program
  • A written risk assessment, reviewed as things change
  • Access controls, an information inventory, encryption at rest and in transit, secure disposal, change management, and activity logging
  • Continuous monitoring, or annual penetration testing plus vulnerability assessments every six months
  • Security awareness training for staff
  • Written oversight of your service providers
  • A written incident response plan
  • A written report to the board at least annually

Reaches mortgage lenders and brokers, finance companies, investment advisers, non-federally-insured credit unions, and tax preparers, among others. Some provisions ease for firms holding information on fewer than 5,000 consumers.

NCUA Part 748

If you are a federally-insured credit union

  • A written information security policy your board approves
  • A risk assessment covering internal and external threats
  • Controls including access controls, encryption, physical security, dual controls, background checks, staff training, intrusion detection, and a response program
  • Due diligence and ongoing monitoring of service providers

One thing worth knowing: banks and federally-insured credit unions are not under the FTC Safeguards Rule at all. They answer to their own regulator. If a vendor quotes you the FTC rule and you are a federally-insured credit union, they have not read your file.

What we do is build the technical safeguards correctly, document what we built, and hand you evidence you can put in front of an examiner. Then we sit with whoever writes the report and make sure the technology sections are true.

Which security rule actually applies to us?

It depends on how you are chartered. Federally-insured credit unions answer to the NCUA. Banks answer to their own federal or state regulator. Mortgage lenders and brokers, finance companies, investment advisers, and non-federally-insured credit unions generally fall under the FTC's Safeguards Rule.

We are not going to tell you which one is yours — you know that better than we do, and your counsel knows it best. What we will do is build and document the technical safeguards so the answer is the same either way.

Can you support more than one branch?

Yes. We connect branches securely, keep the phones and file access consistent across them, and design the network so adding the next location is a plan rather than a scramble. One design, not six that happen to coexist.

What happens when an examiner asks for evidence?

You should already have it. Patching records, backup and restore testing, monitoring, training completion, phishing results, and access documentation are part of how we run the account, not something we assemble under pressure. We will sit down with whoever writes your report and make sure the technology sections are accurate.

What we cannot do is write the program or sign the report. That has to be your qualified individual.

Do you work with our core system or advisory platform?

In most cases we support what sits underneath it — the workstations, servers, network, and backups your platform depends on — and coordinate with the vendor when something needs to change. If a platform has specific hosting or connectivity requirements, tell us early and we will build to them.

How do you keep client information confidential?

Least-privilege access, logged activity, and a local team rather than a rotating offshore queue. Our technicians get the access a ticket requires and nothing more, and we can show you who touched what.

Do you handle the phones too?
